February 3, 2016: A State Department official claims someone tried to hack her private email account two years earlier, in early 2014.

Wendy Sherman is interviewed by the FBI. Sherman served as deputy secretary of state under Clinton (the third highest ranking post), and as under secretary of state for political affairs. Her name will later be redacted in the FBI summary of the interview, but the Daily Caller will identify the interviewee as Sherman due to details mentioned elsewhere in the interview.

Sherman served as chief negotiator on a nuclear deal between the US and Iran, which was agreed to in 2014. In the FBI summary of her interview, she said that she was not aware of any specific instances where she was notified of a potential hack of her State Department or personal email accounts or those of other department employees. However, she “explained [she] was sure people tried to hack into [her] personal email account and the accounts of [redacted] team approximately two years ago during [redacted] in the Iran negotiations. Specifically, [redacted] received a similar email. [She] reported the incident to [State Department] Diplomatic Security who reportedly traced the emails back to a [redacted].”

Elsewhere in the interview, she said that it “was not uncommon for [her] to have to use [her] personal Gmail account to communicate while on travel, because there were often times [she] could not access her [State Department] unclassified account.”

The Daily Caller will later comment, “While it is no surprise that hackers would attempt to infiltrate the negotiating teams’ email accounts — the US government has robust spy operations that try to do the same thing — Sherman’s use of a personal account while overseas likely increased her chances of being hacked.” (The Daily Caller, 9/24/2016) (Federal Bureau of Investigation, 9/23/2016)

August 11, 2016: According the Daily Caller, the FBI is pursuing multiple investigations regarding possible corruption related to the Clinton Foundation.

Additionally, various US Attorney offices in different states are giving assistance. This is according to an unnamed “former official who has direct knowledge” of the investigations. The main investigation is said to be based in New York, which is where the Clinton Foundation is headquartered.

This is being led by Preet Bharara, the US attorney for the Southern District of New York. The source says that Bharara and his office “would be seen by [FBI] agents as a positive development, as prosecutors there are generally thought to be more aggressive than the career lawyers within the [Justice Department].” The office has specialized in large-scale, sophisticated financial frauds. By contrast, the FBI investigation of Clinton’s private email server while she was secretary of state was conducted by FBI headquarters without the involvement of state US Attorneys. It is known that one FBI investigation regarding the Clinton Foundation relates to Virginia Governor Terry McAuliffe (D) and his ties to a Clinton Foundation donor. The Daily Caller report comes hours after an CNN report talking about a failed attempt to start a different Clinton Foundation-related investigation, and makes clear that is not what they are referring to. In October 2016, the Wall Street Journal will confirm the existence of an FBI Clinton Foundation investigation, which has been on-going since 2015.

September 19, 2016: A judge gives the State Department a tongue-lashing over its slow response to FOIA requests.

US District Court Judge Richard Leon criticizes the State Department over what he calls “foot-dragging” regarding Freedom of Information Act (FOIA) requests relating to Clinton’s tenure as secretary of state.

Leon warns Justice Department lawyers, “You have a client that, to say the least, is not impressing the judges on this court, myself included. … It is in your client’s interest to start being more obviously cooperative. The State Department is at risk of being perceived as obstreperous. [They] need to get with the program.”

The hearing is due to a FOIA lawsuit trying to force the release of documents on whether Clinton and her aides were trained to handle classified information. The State Department propose a deadline of October 17, 2016 to produce about 450 unclassified documents relating to the issue sought by the Daily Caller.

However, Leon orders the department to process and release of the records by October 10, 2016. (Politico, 09/19/16)

 

October 17, 2016: It is alleged two disgruntled FBI agents complain about Comey’s handling of the FBI’s Clinton email investigation.

The Daily Caller claims to have a transcript of two active FBI agents who were interviewed by an intermediary on October 14, 2016. Both of them are very critical of the way FBI Director James Comey handled the FBI’s Clinton email investigation.

One unnamed FBI agent “who has worked public corruption and criminal cases” says, “This is a textbook case where a grand jury should have convened but was not. That is appalling. We talk about it in the office and don’t know how Comey can keep going.”

This agent also complains, “We didn’t search their house [the Clinton residence in Chappaqua, New York]. We always search the house. The search should not just have been for private electronics, which contained classified material, but even for printouts of such material. … There should have been a complete search of their residence. That the FBI did not seize devices is unbelievable. The FBI even seizes devices that have been set on fire.”

A different unnamed FBI agent who has “worked counter-terrorism and criminal cases” says he was offended by Comey saying: “we” and “I’ve been an investigator.” This agent points out, “Comey was never an investigator or [FBI] agent. The special agents are trained investigators and they are insulted that Comey included them in ‘collective we’ statements in his testimony to imply that the [agents] agreed that there was nothing there to prosecute. All the trained investigators agree that there is a lot to prosecuted, but he stood in the way. … The idea that [the investigation] didn’t go to a grand jury is ridiculous.”

Joseph DiGenova, a former US attorney for the District of Columbia, says, “People [inside the FBI] are starting to talk. They’re calling their former friends outside the bureau asking for help. We were asked today to provide legal representation to people inside the bureau and agreed to do so and to former agents who want to come forward and talk. Comey thought this was going to go away. It’s not. People inside the bureau are furious. They are embarrassed. They feel like they are being led by a hack but more than that that they think he’s a crook. They think he’s fundamentally dishonest. They have no confidence in him.” (The Daily Caller, 10/17/2016)

October 30, 2016: The FBI’s Miami field office is said to be involved in the FBI’s Clinton Foundation investigation, possibly targeting activities in Latin America.

On this day, the Wall Street Journal reports that FBI field offices in New York, Los Angeles, Washington, DC. and Little Rock, Arkansas, have been investigating the Clinton Foundation for possible financial and political corruption. All the offices have been involved since at least February 2016, though there was a reorganization in mid-July 2016, with the New York office taking the lead.

Later on the same day, the Daily Caller reports that at some point the FBI field office in Miami, Florida, has also joined the investigation. Further details are not given except that “The Clinton Foundation has numerous programs operating in Haiti, the Caribbean, Latin America, and South America.” The Miami office would be the closest to all those locations. (The Daily Caller, 10/30/2016)

The Daily Caller’s claim is given additional credence because the author of the article, Richard Pollock, also wrote an article in August 2016 claiming the FBI’s Clinton Foundation investigation was in existence at a time when nearly all other media outlets failed to report that. That article mentioned details, such as the investigation was being led by the FBI’s New York field office in conjunction with Preet Bharara, the US attorney for the Southern District of New York, that have since been reported elsewhere.  (The Daily Caller, 8/11/2016)
